The Unacknowledge Truth about the U.S. Constitution

by Pat Clark

Point 1.
The Supreme Court IS NOT the final authority on what is or is not Constitutional. Read Article III Section 2 of the Constitution, and pay close attention to the trump card given to congress in the last clause of subsection 2 which states:
In all the other Cases before mentioned, the supreme Court shall have appellate jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.” This means congress can tell the courts to butt out, because there are some matters that are to be left up to the people in either the halls of congress or at the state level.
Point 2.
The amendment process is the only way the constitution can be legally altered. Amendments are the newest laws. At the adoption of the Constitution, the Bill of Rights was included. They immediately altered the Constitution, and the 9th and 10th amendments do two things. Reinforce the restriction put on the federal government to its enumerated powers, and puts all matters not specified in the constitution in the hands of the states, or the people in local communities if the states choose not to address certain issues.
The states can tell all branches of the federal government to mind their own business. Jefferson in his Kentucky Resolution said that states have the right to nullify federal over reach. Madison concurred in one of his Virginia Resolutions by stating that we have a duty to resist federal over reach.
Point 3.
Only the states can define federal over reach. Saying that a panel of federal employees gets to define what is or is not federal over reach is like saying the fox gets to watch the hen house.
Point 4.
Our first amendment right includes the right to peacefully assemble. This implies that we have the right to assemble with whom we want. This means that business owners have the right to assemble the work force they want and the clientele they want. When the federal or a state government tells employers they have to hire certain people or do business with certain people they are not only violating property rights, they are violating the right to assemble.
Point 5.
Our country was founded on the principle of the sovereign individual. Sovereign individuals select representatives at the state level to tend to daily matters on their behalf. The states in turn give certain “limited” powers to the federal government to tend to on their behalf. The proper hierarchy is the sovereign individual, then the states, then the federal government. The federal government is low man on the totem pole. Today it is reversed, and needs to be corrected.
