I’ve got a simple idea: Let’s give up on the Constitution. I know, it sounds radical, but it’s really not. Constitutional disobedience is as American as apple pie. For example, most of our greatest Presidents — Jefferson, Lincoln, Wilson, and both Roosevelts — had doubts about the Constitution, and many of them disobeyed it when it got in their way.

To be clear, I don’t think we should give up on everything in the Constitution. The Constitution has many important and inspiring provisions, but we should obey these because they are important and inspiring, not because a bunch of people who are now long-dead favored them two centuries ago. Unfortunately, the Constitution also contains some provisions that are not so inspiring. For example, one allows a presidential candidate who is rejected by a majority of the American people to assume office. Suppose that Barack Obama really wasn’t a natural-born citizen. So what? Constitutional obedience has a pernicious impact on our political culture. Take the recent debate about gun control. None of my friends can believe it, but I happen to be skeptical of most forms of gun control. I understand, though, that’s not everyone’s view, and I’m eager to talk with people who disagree.

But what happens when the issue gets Constitutional-ized? Then we turn the question over to lawyers, and lawyers do with it what lawyers do. So instead of talking about whether gun control makes sense in our country, we talk about what people thought of it two centuries ago. Worse yet, talking about gun control in terms of constitutional obligation needlessly raises the temperature of political discussion. Instead of a question on policy, about which reasonable people can disagree, it becomes a test of one’s commitment to our foundational document and, so, to America itself.

This is our country. We live in it, and we have a right to the kind of country we want. We would not allow the French or the United Nations to rule us, and neither should we allow people who died over two centuries ago and knew nothing of our country as it exists today. If we are to take back our own country, we have to start making decisions for ourselves, and stop deferring to an ancient and outdated document.

And, so just which parts are we going to give up on?  That pesky 1st Amendment that gives dolts like him to speak the garbage he does?  Or, the 2nd Amendment that allows the people to arms themselves against a tyrannical government whenever IT decides to ignore Constitutional protections?  Or, how about that 4th Amendment that guards against unreasonable searches and seizures?  Or, how about that 5th and 6th Amendments that guard against self incrimination and assurances of counsel?  Or, the 8th that prohibits cruel and unusual punishment?  Or, the 10th that allows the states to retain powers not granted specifically to the federal government?  And, of course it goes on and on…….

Of, course we ALL know the answer.  People like him would dispose of any Con-right that liberals like HIM decide are no longer needed.  And, knowing liberals……that would mean that they would eventually do away with the entire Constitution and Bill of Rights.  Obama and his admin are proof of what liberals mean to evenutally do…….

And, what is this “take back our country” stuff?  The Federal Constitution is the ONLY thing so far that so far allows us to RETAIN anything that we have.  What is he proposing that we “take back”?  What he REALLY means is that we need to “do away” with our country by doing away with the Con.

He’s just another pointy headed radical left wing ideologue that thinks he and his liberal pals know whats best for the rest of us.

Exactly.  As Obama has lamented “it is a list of what the government may not do” instead of a list of “what the government can do on your behalf”.  It is the only thing stopping the government from taking away all your rights,  and then giving you back te ones they think you  deserve.   Heaven help us, this guy is not alone, plenty of people despise the Constitution because of the limits it puts on government powers.

His true motive is exposed with this seemingly innocuous question:  “Suppose that Barack Obama really wasn’t a natural-born citizen. So what?”

At the heart of his concern and fear is his awareness that Obama actually is NOT a natural born citizen and could be declared to be ineligible for the office of President.  Then every bit of legislation and all executive orders that he’s signed would be null and void.  THAT’S the fear that drives his attempt to undermine the sanctity of fundamental law.

So being a “nation of laws” is meaningless to a professor of law?  Our Constitution, the base of our laws, should mean whatever we want them to mean today…?

Let’s look at countries that ignored their Constitutions and made them mean whatever they wanted for “today”, such as the USSR and communist China.  The USSR had 3 constitutions, one every 20 years, and ignored their “outdated documents” from the day they were written.  China  has also had 3 constitutions, one lasting 2 years.  Both countries happily ignored written law, and implemented courts for “today”,  imprisoned and tortured opponents.   Yep… getting the nation they deserved for “today”.

Stalin and Lenin would call Georgetown law professor Louis Michael Seidman a “useful idiot”.   I think he’s just a academic fool.  Georgetown should fire him.

I’m not surprised that CBS would like to do away with the Constitution.  It’s one of the few things that protects us from the kind of tyranny they would like to see imposed.  It’s nice to hear one of the MSM puppets finally mention the idea that Obama’s not a natural born citizen.  We would have been much better off if we had more closely enforced the Constitution: no Obama, no Obamacare.  Wait until that ugly monstrosity takes full effect.  We had more deaths from suicide than auto-accidents last year!  Times change, technology changes but people don’t change.  The Constitution was written by people that understood human nature.  It’s just as pertinent now as ever.

There is so much anger out there right now over Obama’s executive orders and Feinstein’s bill which would allow Government officials to own “assault weapons” while preventing  non-government civilians from doing so.  Now it turns out that DHS is buying 7,000 Personal Defense Weapons which are the same weapons knows as assault rifles when they’re in civilians hands.
We need a spark to unite us, a leader to organize us, and the will to take back our government and our country.

I watched the first 30 seconds of this crap this morning before it induced unintentional projectile vomiting. How could anyone claiming to be an academic say something that is so completely in opposition to the laws that make up our country? I was not impressed. I was thinking that this person should be assassinated for the good of the country. I say we all give up on CBS News. I know I have. The problems that we have come from a steady erosion in the principles and rules put forth in the Constitution. It has been our ignoring of those principles put forth in the Constitution, The Bill of Rights, and the Ammendments that have caused the problems. If people think the Constitution is so bad the way it is, then propose a constitutional convention to create more Ammendments. Liberals won’t do that because they they know 2/3 of all the states must vote for ratification. It is not like the electoral college where some states count more than others. Liberals would get skunked.

I say we have a new Ammendment to the Constitution stating that States may peacefully withdraw from the Union keeping all federal property within their borders. Then the politicians would have to tread more carefully to preserve their power. Political power would shift back to the states where it was intended to remain.

How about an amendment that declares that all federal property within the borders of states shall be ceded back to the states after statehood has reached the half-century mark if the property is not currently occupied and utilized?  That would remove about 50% of the nation’s land from the federal government, paring it down to its proper size, while greatly enlarging the scope of authority of half the states of the nation (those in the West and Alaska).

That didn’t work so well for them.
So now they’re trying to pretend that we’re all being held captive by people who died hundreds of years ago and that we should toss the constitution aside because it is “out of date.”

The US constitution is the highest law of the land and a covenant between the federal government, the governments of the many states, and the American people.  Without it, the federal government ceases to exist.  Without it, there is no rule of law.

That is precisely why the left wants to do away with it.  Our constitution is a lasting and effective protection against an ever-growing and ever more intrusive state.  This is also why the left wants to do away with it.

People who go around describing themselves as “liberal” want to take away our liberty.  They want to destroy our rights, chief among them the right to self-determination.  They do not want a free society in which each individual is empowered to pursue self-chosen interests through self-chosen means, but a MANAGED society in which the majority is directed and controlled by a minority, for their own good of course.

Let me say this as plainly as possible.  I will dedicate my last dying breath to the utter annihilation of anyone who attacks or otherwise undermines our constitution and the rights and freedoms its structure safeguards.  If they want an existential struggle for the future of mankind, I’ll be happy to accommodate them.

Americans have already fought one civil war to end slavery.  Fighting another to prevent it is perfectly fine with me.

This is a superb counter-argument to the mindless drivel you were responding to….  The Constitution is a great document that has been the model for most similar documents adopted throughout the world. Obama can ignore it to a degree because the Democrat Senate will never agree to impeachment AND the Attorney General is a crony pure and simple. THEY are the problem, not the document.

We need a constitutional amendment that puts the appointment of the Attorney General into the hands of the House of Representatives.  With that office being appointed by the President, it is compromised and in a conflict of interest in any situation such as Watergate and Benghazi-gate, and Fast & Furious in which the AG is obstructionist in order to politically shield his boss.

how about states that pass laws to recall their Senators and Congressmen if they ever introduce legislation or vote in favor of any infringement on the 2nd Amendment or any other portion of the Constitution they will be found criminal, recalled and imprisoned in the state they represent for 10 years and never collect their precious retirement or benefits, nor ever hold public office again.

There is no document in existence that can survive the wllful disregard of those sworn to protect it.  Only the people can then defend it, and themselves against tyanny.

Amen, Steve.   What the Founders gave us was a system of checks and balances.  The judicial, executive, and legislative branches all serve to check each other.  We, the People, through our votes serve as a check on all of them.  And when all else fails, the last and most important check the Founders gave us is the 2nd amendment.

The genius of our Republic is that we are a nation of laws, not men.  It doesn’t matter if you are liked, disliked, or hated.  Your rights are not subject to popular opinion.  No one can deprive you of your life, liberty, or property just because you’re not part of the popular crowd.

Direct democracy is exactly what got us where we are today. Just because you can fog a mirror doesn’t mean you should be able to vote. Voters should be “informed” and have “skin in the game”, neither of which a huge percentage of Americans have. When the uninformed and unproductive and greedy gain control of the government, we are all doomed. A repubic is based on a set of universal rules and the Constitution is the set of rules we Americans are supposed to adhear to.
